Taking the elements of the Penguin away, (the nose and the short squatness of the character) would just change it too much to be recognizable. Escalation is what Gordon called it.
The Penguin should NOT be a circus freak ala Batman Returns, but a normal criminal mastermind, with a long sharp nose, a monocle and cigarette smoker (with holder).
His choice in clothing must remain somewhat consistent. He may not HAVE to wear a tux all the time, but I'm sure there's a good opportunity for him to wear a tux at a formal Gotham event. Likewise the top hat. Realism is great, but to sacrifice what made these characters so appealing by taking them so far out of the fantasy world they belong in is wrong and will ultimately destroy this franchise...AGAIN. Too much fantasy and glitter glam in the last movie series....hopefully they will find the perfect balance in this one. The Joker has BETTER have bleached skin and green hair... otherwise...what's the point?

I saw Mission Impossible 3 & Capote recently. I have no doubt that Phillip Seymore Hoffman should nab the role of The Penguin. He's a cemeleon just like Gary Oldman, I have no concern about his acting, just about the look of the character. Yeah, he really stole the show in the first scene of M:I-3 ("YOU THINK I'M PLAYING?!"). I find it ironic that he played an arms dealer in the show since he's been rumored for Penguin, who himself has been rumored to be protrayed as an arms dealer. Seeing him in the tux at the Vatican helped me envision him as the Penguin. Dye his hair black, give him a monocle, and put a cigarette holder in his mouth...I'd love to see a manip of that and I don't think he'd have much of a problem with that since he changes his looks for most of his parts anyways.

Capote pics were probably the best base pics at the time, but I think a pic of his character from M:I-3 in the Vatican would be better.

IMO the biggest thing that was done wrong this the penguin the first time around, other than the fact that he comes from the sewer and in fact is not a mastermind, is the "flippers" in place of hands. that one thing took it over the edge.
on a side note, can anyone explain to me why there were penguins waiting to welcome baby penguin into gotham sewer before the penguin was there? this is actually in returns.

OK I got the most awesome but wild idea for who should play the penguin. Bare with me for this. OK I think that for Begins 2 they should give the role of the Penguin BACK to Danny Devito. Ok before you go all "but he played him in returns" think of this. IN the new movie, at most the penguin is gonna have is a nose extention. Hes not gonna be in the full makeup and getup. Just get Devito to speak in proper english and not be so angry, I think people wont realize that its the same person. Hes playing the same character yes, but in completely different ways. I like devito for this role because hes got the right form, stature, and look for the penguin. I think it could work.

Well Dr. Green I am inclined to agree with you. I wouldnt have any problem whatsoever with Devito taking another stab at the character. He is honestly the only actor from the previous films I would welcome back... let alone in the very same role. Whether or not Devito would accept is another issue though.

Sorry, but I'd have to say no to Devito back as Penguin. He did his Penguin before for Returns, but this is a new series of films and anyone from the previous four should not be involved in any way.
